With the Republicans in control of both Houses in the North Carolina Legislature, there was no question that some kind of "reform" was going to take place in the area of Workers Compensation. They have won tremendous 'victories' by destroying the rights of patients in emergency rooms who are hurt by negligent doctors, and eliminating other rights long enjoyed by North Carolinians.

Fortunately, due to the hard work of many of you, as well as the North Carolina Academy for Justice, and many of our legislators working tirelessly to hammer out a compromise, the final verion of the law is nowhere near as bad as that which was originally proposed.

The new laws, which took effect on June 24, 2011, significantly affect many of the rights which workers in North Carolina have enjoyed for a long time, but it could have been much worse.

Most significantly, 
instead of arbitrarily cutting off TTD at 500 weeks from the date of the accident, as proposed originally, under the compromise bill, there is another means for a disabled worker to continue to recieve compensation beyond the 500 weeks.

When the employee has reached 425 weeks of TTD from the date of first disability, they can seek "extended compensation" beyond the 500 weeks by showing that they still have a total loss of wage earning capacity, through the medical evidence provided by their doctors.

In the previous version of the Bill, there was no allowance for any extension beyond the 500 weeks, no matter what the employee's physician said.

In addition, however, the compromise Bill reduces any compensation beyond the 500 weeks by the amount of Social Security Retirement Benefits received by the employee.

To be sure, the new Act is still plenty bad: The once valuable tool of the Independent Medical Examination has been severly restricted; employers can now force workers recovering from injuries to accept 'make work' at greatly reduced pay.
