North Carolina Law Firm Provides Clients With Work Injury Book

Perhaps you have been injured and you are trying to work with your employer by working through your pain. Maybe you know someone like this, perhaps a spouse or a sibling, or a friend. Perhaps you are refraining from making a workers compensation claim because you think that you're going to lose your job if you do.

Maybe you are showing up to work every day in pain, because that is what you think you have to do for your family. Maybe you feel that you are the type of person who doesn't " sue" people, and therefore you feel guilty about the possibility of making a workers compensation claim against your longtime employer.

LOSING YOUR RIGHTS

Whatever the reason, you need to understand one thing--- By failing to enforce your rights under the law, you are probably losing and destroying your rights under the law.

The most common mistake that is made is for people to try to "work through" their injuries. They are repeatedly reassured by supervisory personnel that if things get bad enough, they can make a claim 'later', but for right now, you just need to try to "work with the company." Maybe your employer has told you that you can "take it easy" for a while, and that your fellow employees will assist you. Maybe they have suddenly found a "job" for you to do that is very light to give you time to recover from your injuries. In the meantime, you are urged not to give notice of any injury, and just see how it goes. "You can always make a claim later if you feel that you have to, " you are told.

Time and time again, what ends up happening is that after two or three months, your injuries become worse and worse, until finally, you can no longer take it. Maybe the company begins to give you more and more physically difficult assignments. As your pain increases, maybe some of the supervisors are becoming less patient with you.

All of a sudden, you find that you are being scrutinized much more then before you got hurt. You do not understand why they have this attitude. After all, you have been a loyal, hard-working employee for a long time. How can they treat you like this?

Finally, you go to your supervisor and tell him or her that you are unable to perform your duties because the pain is so severe. You know something is seriously wrong, and you tell him or her that you guess it is now time to make a claim for that injury you suffered from three months ago and that you definitely need to get to the doctor.

Suddenly, your supervisor is acting pretty strange. Maybe he or she blames upper management for your inability to now allow you to make a claim. Now your supervisor says it is too late, and that if you cannot perform your duties, they may have to let you go.

Or, even worse than that, you are shocked to hear the supervisor say he or she is not sure what you are talking about. What injury, they ask? You never said anything about any injury!

Has something like this scenario happened to you or a loved one? It certainly could.

The end result---You are fired, left without a job, with no way to pay for your medical bills or treatment that you now realize you should have pushed for.

How did this happen? Why did this happen?

Because the folks in charge of your potential claim are not the same folks you have had a warm relationship with for years at your job. Your claim is being handled, and the shots being called by the workers compensation insurance company.

And that insurance company has now done a wonderful service for its stockholders. They have managed to manipulate you so that they can deny your claim for failure to make a timely report of injury, and failure to give notice of your injuries to your employer. If your employer claims you were fired for cause, you may not even be entitled to unemployment. And since it has been so long since you got hurt, even if you can afford a doctor's appointment, a doctor may not be able to even say that your injuries came from a work accident!
